we were close to buying a car 5k holden vectra - looked fine, sounded fine reasons for selling seemed genuine. Then got a vehicle check which listed the previous owner and tried looking up name in the phone book and there they were so rang them. turns out the car was not fine and they had sold it to this vendor for $1000 because of the computer faults and problems disclosed fully. Told me what needed fixing and I point blank asked the vendor whether they had fixed these. They didnt answer. I checked their selling history and found a string of cars spanning four years - way too many for a personal seller. Car didnt sell, they relisted I posted my comments about the car so others could see, complained to trademe but that was all I could do

Considering most traders use a pseudonym and their profile just says 'Jeff' from Whykickamoocow, with an Gmail address, how do you go about getting the information to take them to the disputes tribunal? Then How do you follow up the award?

How about if you buy a product, using "buy now" from a professional trader (they are selling several of the same thing, clearly a business) which is sold as a "Genuine Brand X", and when you get it, it is clearly not the genuine article?

Surely you have recourse under the consumer guarantees act in that instance (ie goods not as described)?

Yes, recourse under the CGA, and Fair Trading Act. If they are knowingly selling this, I would also let the Trade Me compliance team know, who will investigate.
If you bought the same mislabelled product from a private seller, you could possibly cancel the contract and claim compensation under the Contractual Remedies Act.

Really annoyed we brought a bumper off trade me thought it was legit, didn't fit went to sell it on trade me, trade me emailed us gave us a nasty warning, took our money to list item, and said it was counterfeit, I rang as directed cost ME 1.99 a minute, told them story they looked it up seen the guy was still selling his item, and saw we had indeed purchased our listed item off him. Said oh we will talk to him, we asked for complaint to be dropped and listing fees back as it was obvious we brought it in 'good faith' and got told NO, asked to speak to someone higher, NO, asked her name NO cant for privacy reasons, Trade me treat consumers like dirt and by the sounds of it can legally do so! What can we do?
