Can I demand a Refund?

Hi, I purchased a Samsung 40" LCD monitor less than four months ago for $2k and it has stopped working (will not turn on).
Considering the amount paid I should expect this product to last longer than 3.5 months. I now have complete lack of faith in this brand and model and wish to redirect my investment.
I want a refund and not a repair.
Is there anything I can cite under the CGA that will allow me to get this outcome?

Hi,
My wife and I purchased 200 square metres of t&g flooring, my flooring installer says there is at least 60-70% wastage. We purchased what we assumed was a knotty grade. The price of the timber was very reasonable but the majority is unusable.
We looked at the timber before it was processed into t&g, but could not tell that there were such significant defects in the flooring.
The wastage includes holes and structural damage throughout the timber.
There are holes at regular intervals 1-2 metres apart throughout most of the timber.
Are we covered under the CGA? Can we demand a full refund in this situation?

I brought a Daewood TV on Jun 2006 directly from Daewoo, it has gone faulty and its been a month now and they still havn't sourced the spare part to fix it. Daewoo still have no ETA on the part, what can i do?

Hi Michael,
The Consumer Guarantees Act gives you the right to spare parts and repair facilities for a reasonable time for any product unless you are told when you make your purchase that they aren't available. This undertaking is given by the manufacturer or importer and not the retailer. It applies to all new goods.
If none are available, the remedy in your situation is that of compensation - difference in the value of what you should have, and what you actually have got.
I purchased a Sony 40 inch LCD TV in Feb 06, it cost $4000.00 and two weeks ago it stopped working. Do I have any comeback with either the retailer or Sony?
SSV Holden just out of Warranty

We purchased a 2006 SSV Holden which is only a month out of its 3 year warranty. (52,000km's)
In June 2009 we had to get the CD/Radio/Air conditioning console replaced as we were have problems with it, this was covered under the warranty. We are again having problems with the replacement console Ebbett Holden are telling us that we are no longer covered and we will have to pay $1400 to get this fixed!!!
Are we covered under the CGA??

hey i just joined Consumer.org to ask this question and hopefully get an answer.
I bought my 40GB PS3 around December 2007 which came with 1 year warranty so i was covered until December 2008 but since its now October 2009 i have been out of warranty for 9 months now.
Anyways i'll get straight to the point, my PS3 broke down 3 days ago, so i called up Sony, and well they will charge $315 to fix since its out of warranty.
I've had the PS3 for a total of 21 Months now, am i still covered under CGA?
I bought my PS3 from Hill and Stewart btw, and the PS3 broke down all of a sudden, no physical damage, i haven't dropped it or anything, and i have used a surge protector the same day i bought it. I was playing online, turned it off to eat, came back 30 mins later and got the Yellow Light of Death. Random problem. PS3 still starts up but shows a yellow light then a red light starts flashing.
I'm going to ask Hill and Stewart but i'm sure they will try and say NO because i don't have warranty, just want to make sure if i'm still covered under CGA before taking things further.
Appliance fails, retailer dissapeared!

I purchased 2 induction cookers off the Retailer, 1 a year ago and 1 2 years ago. 2 months ago, they both started not working, now 1 doesn't work at all and 1 sometimes work, sometimes doesn't. We then found out the the retailer doesn't exist anymore, how to get it repaired? They were the only importers of this german product. I have found an email address which I have emailed (purchased something off them personally on Trademe, thank goodness I kept it!), asking the retailer to repair the product. Do I have any rights if the retailer refuses (assuming that they return my email) since the business doesn't exist anymore.
Hi, we are having a similar problem after PS3 suddenly just died. It is a 60gig and bought in the first release. When we rang PS3 they told me the same thing. That the unit was out of warranty, and the cost of $375 to repair it. However one day in at the retailers where it was bought, it was discovered I had an extended warranty. The machine was sent off, 12 weeks later it came back, turned it on, went fine for that night but next day froze with game inside. So back off it went for repair. 4 weeks later still no sign of it.
What I would like to know is what can I do now? Can I go in to retailer and ask them for a new unit?
